Exabyte Infotech Pvt. Ltd, a private limited Company incorporated under the Companies Act, 1956 in India (and, or its successor entity, hereinafter “EXABYTE” or “we”) provides a technology platform in the name and style of www.exabyteinfotech.com and / or Exabyte mobile website and / or Exabyte App on Android Play Store or iTunes Store, other Exabyte tools and services (the website, mobile website, services, tools and Apps hereinafter individually or collectively referred to as the “Platform(s)”) to its customers, potential customers, technology service providers and general audience (collectively, the “Users” of Platforms or “You”).

Applicable Laws for Privacy Policy

We respect the privacy of the Users and are committed to protect Users’ privacy in all practical aspects in fullest compliance with regulations and laws applicable in India (the “Applicable Laws”), regardless of the region or jurisdiction from where you access the Platforms. This privacy policy also addresses the concerns of those Users who are concerned with the use of their ‘personally identifiable information – i.e. any information or collection thereof which can be used to identify you as the definite person you are (the “PII”). Updates to Privacy Policy

EXABYTE believes that the Internet is an ever-evolving medium. We may periodically review and change this privacy policy to incorporate changes as may be considered appropriate inter alia on account of changes in applicable laws and Regulations. Unless the applicable laws prescribe otherwise, our use of information we gather will always be consistent with the policy under which the information was collected, regardless of what the new policy may be. You further agree that we shall have an absolute right to amend and update terms of this Privacy Policy at any time and from time to time, while retaining compliance with Applicable Laws. We shall publish updated Privacy Policy on the Platform(s) and it shall become effective within seven days of publication of updated Privacy Policy. Personal Information

“Personal information” or “PI” is information that is associated with a specific person inter alia way of using or surfing websites / Apps and the patterns that can be used to identify the user or his behavior. All user information including the information as supplied by the users enables us to improve EXABYTE Platforms and provide you the most user-friendly and customized experience for serving you in a better way. Please be advised that we do not consider personal any information that has been made anonymous or aggregated so that it can no longer be used to identify a specific person. This Privacy policy describes our policy for collection, use, retention, disclosure and protection of your personal information / PI. It applies to this website www.exabyteinfotech.com, all its pages and to all of EXABYTE Platform(s) you may access, regardless of whether this Privacy Policy is referenced in only one or more of such Platforms and regardless of how you access or use a Platform, including through mobile or any other devices.

We respect your privacy and we are committed to protect your privacy in compliance with Applicable Laws. Protecting your PII, if any collected by us or our IT systems, is an article of faith and a part of our corporate ethos. We shall therefore only use your name and other information in the manner set out in this Privacy Policy. Our IT systems may collect information that is expedient in the process of allow you an efficient use of the Platforms or in any way makes it easier to enable you secure the features or services you might be interested in. Further, we will collect information which is relevant in our dealings with each other. Collection of personal use

We may collect, process and retain information from you when you enter information on our Platform particularly when:

Personal information we collect automatically when you use our Services or register for an account with us. We also collect information about your interaction with our Services, your preferences, and your communications with us. This is information we receive from the devices (including mobile devices) you use when you use our Platforms or services available within Platforms or our third party partners’ platforms, register for an account with us, provide us information on a web form, update or add information to your account, participate in community discussions, chats, or dispute resolution, or when you otherwise correspond with us regarding our Services. EXABYTE’s web servers automatically collect limited information about user’s computer’s connection to the Internet, including user’s IP address, your usual timing of visits our Platform. User’s IP address is a number that lets computers attached to the Internet know where to send data to the user. The User’s IP address does not identify the user personally. EXABYTE uses this information to deliver its web pages to users upon request, to tailor its site to the interests of its users, to measure traffic into our Platforms and let our advertisers know the geographic locations of visitors to EXABYTE’s Platforms.

EXABYTE may post the changes in a revised Privacy Statement. You are responsible for regularly reviewing this Privacy Statement to obtain timely notification of such revisions.

By providing the information above you agree that EXABYTE representative(s) may call to assist you further and address your enquiry between 9:00 am to 9:00 pm. You agree that this information will supersede any ‘Do Not Dial’ mandates you might have given to your telecom service provider or with the “Do Not Call” registry.

PAYMENT INFORMATION: EXABYTE may use a third party to process and verify credit cards / Debit Cards and other electronic modes of payment for receiving payments. When processing a payment transaction, EXABYTE (and its third party payment gateway / data processors) will obtain information regarding amount, IP Address, other relevant transaction data. We may transfer or disclose information relating to you and amounts due to a third party as necessary in order to complete the payment processing.

OTHER DISCLOSURES: EXABYTE may also disclose or transfer information regarding you (i) in order to complete a transaction requested by you or to provide a service to you, (ii) as required under Applicable Law or government order, (iii) pursuant to your request, (iv) as necessary to enforce our rights or (v) to protect us from loss or a fraud.

Personal information from other sources

We may supplement the information we collect with information from third parties and add it to your account information. For example, we may collect and use demographic information that is publically available, additional contact information, credit check information, and information from credit bureaus, as allowed by Applicable Laws.

We may allow you to share information with social media sites, or use social media sites to create your account or to connect your account with the respective social media site. Those social media sites may give us automatically access to certain personal information retained by them about you (e.g., content viewed by you, content liked by you, and information about the advertisements you have been shown or may have clicked on, etc.). If you provide us with access to any site with video content, then you agree that we may share your video viewing with, or obtain information about your video viewing from, third-party social media sites for at least two years or until you withdraw consent. Third party disclosure

We do not sell, trade, or otherwise transfer to outside parties PII unless we provide you with advance notice. Our partners (website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you) may however be in a position to collect PI or PII in usual course of providing services to us. We sign proper confidentiality agreements with all our Partners with the aim to protect any PI or PII that such partners may access as part of services delivery to us. We may also release PI or PII when we in good faith believe that such release is necessary to comply with the Applicable Law, government orders or subpoena, enforce our Platform policies, or protect ours or others’ rights, property, or safety. However, we may provide/share non-personally identifiable visitor information to other parties for marketing, advertising, or other uses at our discretion, with a view to tailor-make solutions and advertising that may suit you.

Third party links

We may occasionally include links to other websites. Such websites are governed by their respective privacy policies, which are beyond our control. Once the user leaves our servers (the user can tell where he/she is by checking the URL in the location bar on the user’s browser), use of any information provided by the user is governed by the privacy policy of the operator of the site which the user is visiting. That policy may differ from our own. If the user can’t find the privacy policy of any of these sites via a link from the site’s homepage, the user may contact the site directly for more information.

Third party advertiser

We wish to inform you that we use third-party advertisers to serve ads when you visit our Platforms. These advertisers may use information (excluding your name, address, email address or telephone number) about your visits to this and other Web sites in order to provide advertisements about goods and services which might interest you. When EXABYTE presents information to its online advertisers — to help them understand our audience and reiterate the value of advertising on our Platforms — it is usually in the form of aggregated statistics on traffic to various pages within our Platform. We along with third-party vendors, such as Google use their respective cookies (such as the Google Analytics cookies) and third-party cookies or other third-party identifiers, sometimes analyzed collectively, to compile data regarding user interactions with ad impressions and other ad service functions.

Use of personal information

We use the personal information we collect from you in our endeavors to serve you in a better way on our Platforms and in particular to:

    • Improve and / or personalize user experience, advertising & marketing;

    • Contact you about your account and our Services,

    • Provide information about our Customer Services endeavors;

    • Make an attempt to understand your requirements;

    • Detect, investigate, prevent and mitigate fraudulent or illegal activities.

We retain your PI/PII as long as it is deemed necessary or expedient for our operations. In addition, we may retain personal information from closed accounts to comply with Applicable Laws, prevent fraud, resolve disputes, troubleshoot problems, enforce our terms of use or collect fees (if any owed), and take other permissible actions. After it is no longer necessary for us to retain PI/PII, we may destroy the same pursuant to our policies without incurring any obligation to you or third parties. All information gathered by us is securely stored within our database. The database is stored on servers secured behind a firewall. Access to such servers is password-protected and limited on need-to-know basis. However, you must understand that even though our security measures are adequate and compliant with Applicable Laws at relevant point in time, no security system is impenetrable. Thus, we do not guarantee the security of our databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet. Exabyte Platforms are scanned on a regular basis for security loopholes and vulnerabilities in order to make your visit to our Platform safe and enjoyable. We use regular malware scanning. We implement a variety of security measures when a user submits, or accesses PI/PII. All financial information such credit/debit card details are processed through authorized payment gateway service providers.

Marketing

If you do not wish to receive marketing communications from us, you can unsubscribe by clicking on the link in the email you receive, change your Communication Preferences with us through any mode we offer within a given timeframe. We do not sell or rent your personal information to third parties (except our related entities within Exabyte group and business associates) for marketing purposes without your explicit consent.

If you attempt to change your password, User ID, update any other account information or attempt other account activity beyond those listed above, you will be asked to enter your password. You can typically end your signed in session by either signing out and/or clearing your cookies. If you have certain browser privacy settings enabled, simply closing your browser may end your signed in session – you must verify with your IT advisor.
